Jean-Lucien Bussa, Minister of Portfolio, and Miguel Kashal Katemb, Director General of the Autorité de régulation de la sous-traitance dans le secteur privé (ARSP), signed a memorandum of understanding on Tuesday, November 12, 2024, aimed at promoting inter-company cooperation in line with the proposal made by the Minister of Portfolio to the Council of Ministers on July 19, 2024.
The signing ceremony took place in the meeting room of the Cabinet of the Minister of Portfolio, in the presence of experts from both parties.
Benefits of this memorandum of understanding
This memorandum of understanding establishes the gateways for collaboration, mutual support and information sharing concerning the implementation of inter-company preferences by private companies with which State Portfolio companies carry out transactions on their assets.
Accordingly, each company in which the State has a shareholding must give priority to directing its needs and orders towards other State trading companies, with priority given to companies in the State Portfolio.
However, priority will be given to private companies with which Portefeuille de l’Etat companies carry out transactions involving their shares.
According to Maitre Didier Kashala Kamanda, Director of Operations at ARSP, this memorandum of understanding will facilitate the implementation of inter-company preferences by private companies with which Portfolio companies carry out transactions. It will also enable public-private partnership (PPP) experiences to be shared.
“It was essential that in the context of subcontracting, transactions, subcontracting activities should also be channeled to companies in the State portfolio, as these companies have stakes in these private companies that carry out subcontracting activities,” he said.
It should be noted that a consultation framework has been set up to exchange information.
Under article 3 of the memorandum of understanding, a joint coordination unit will be set up, made up of experts from the Ministry of the Portfolio and the ARSP.
For Minister Jean-Lucien Bussa, the appointment of these experts and the drafting of the rules of procedure are a matter of urgency.
During a Council of Ministers meeting on July 19, 2024, the Government of the Republic adopted a measure concerning inter-company collaboration within the Portfolio.
To put it plainly, Jean-Lucien Bussa had suggested that the companies in the Portfolio should give each other preferences in terms of the products and services they generate.
